The future Royal Decree on extraordinary regularization of migrants receives 350 contributions and queries

The Royal Decree Project to extraordinary regularize more than half a million migrants launched by the Government has received 350 contributions and queries during the public hearing process, which ended on Friday, February 6.

The Secretary of State for Migration is currently working to evaluate and incorporate the proposals received as soon as possible and thus continue with the urgent processing of the royal decree that will enable the process of extraordinary regularization of foreigners who are in Spain.

On January 27, the Council of Ministers approved to begin the emergency process to extraordinary regularize more than half a million migrants, following an agreement between PSOE and Podemos. The draft Royal Decree modifies the Regulation of the Organic Law on the rights and freedoms of foreigners in Spain.

The text, which is not definitive, resumes the spirit of the ILP, which was supported by more than 700,000 signatures and taken into consideration in the Congress of Deputies in 2024 by all groups except Vox, but which has remained blocked.

As announced by the Executive, the process will be aimed at all foreigners who were in Spain before December 31, 2025 and who prove that they have spent at least five months continuously in Spain at the time of submitting the application. These circumstances may be proven with any public or private document or a combination of both.

In the case of applicants for international protection, it will be sufficient that said application has been submitted before December 31, 2025 and can be accredited.

Another requirement will be not to have a criminal record or pose a threat to public order. People who participate in this process and prove compliance with the requirements will be able to access a residence authorization in Spain with an initial validity of one year. After this period, they must be incorporated into the ordinary figures provided for in the Immigration Regulations, which allows full and progressive integration into the system.

The scope of the project is mainly aimed at people who have already been in Spain for a long time and who have been left outside the ordinary channels of regularization, including those with pending or denied applications for international protection who have not been able to benefit from the different forms of roots. The measure will be applied generally, without distinction of nationality, as long as the established requirements are met.

On the other hand, the process will allow the simultaneous regularization of the minor children of the applicants who are in Spain, whose permit will be for five years.
